The term "piracy" usually refers to the ethical side of the issue, not the legal side. For example, pirating a game is piracy (which is copyright infringement and either illegal or legally grey in most places), but "pirating" a program that's free (or a game you already own) should not be considered piracy (it would be considered "copyright infringement" or "technically illegal according to the DMCA").
